These Terms and Conditions (“Terms”) govern your access to and use of our website located at https://macgrovepainting.com/ (the “Website”), including any content, functionality, and services offered on or through the Website, such as requesting quotes or information about our painting services.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to use the Website:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit any material that is defamatory, obscene, or otherwise objectionable.

We reserve the right to terminate or suspend your access to the Website at any time, without notice, for any reason.

2. Services and Quotes

The Website provides information about our painting services, including interior painting, exterior painting, house painting, commercial painting, drywall repair, ceiling painting, wallpaper removal, and related services for residential and commercial clients in the Twin Cities metro area and select surrounding communities in Minnesota and Wisconsin.

Any quote or estimate provided through the Website, email, phone, text, or in person is preliminary and non-binding. Final pricing, scope of work, timeline, and terms will be set forth in a separate written Painting Services Agreement (or contract) signed by both parties before work begins. Quotes are valid for the period stated (typically 15–30 days) unless otherwise noted.

3. Contract Formation and Project Terms

No contract for services is formed by submitting a quote request, receiving an estimate, or any preliminary communication. A binding agreement arises only upon mutual execution of a written Painting Services Agreement, which will include:

  • Detailed scope of work
  • Materials to be used
  • Project timeline and start/completion dates
  • Payment schedule
  • Any warranties
  • Change order procedures

The specific terms of that signed agreement will govern the project and supersede any conflicting provisions here.

4. Payment Terms

  • A deposit may be required to schedule work (amount specified in the signed agreement).
  • Progress payments and/or final payment are due as outlined in the agreement.
  • A 3% surcharge will be added to all credit card transactions to cover processing fees, as noted on the Website.
  • Late payments may incur interest at the rate of 1.5% per month (or the maximum allowed by law).
  • You are responsible for any collection costs or fees if payment is not made.

5. Cancellations and Changes

Cancellations or changes after a signed agreement must be in writing. Deposits may be non-refundable or partially refundable depending on timing and expenses incurred (detailed in the project contract). Change orders for additional work may result in adjusted pricing and timelines.

6. Limited Warranty

We warrant our workmanship for a period of 2 years from completion against defects such as peeling or blistering caused by improper application (subject to conditions in the signed agreement). This warranty does not cover damage from normal wear, misuse, structural issues, moisture problems not disclosed, or third-party actions. Materials are warranted only per the manufacturer’s terms. This is the sole warranty; all other warranties (express or implied) are disclaimed to the fullest extent permitted by law.

7. Limitation of Liability

To the fullest extent permitted by law, MacGrove Painting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Website or our services, even if advised of the possibility. Our total liability shall not exceed the amount paid for the specific project giving rise to the claim.

We are not responsible for delays due to weather, material shortages, unforeseen site conditions, or events beyond our reasonable control (force majeure).

8. Indemnification

You agree to indemnify, defend, and hold harmless MacGrove Painting, its owners, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your use of the Website, or any project-related issue caused by your negligence or failure to disclose relevant information.

9. Intellectual Property

The Website and its contents (text, images, logos, etc.) are owned by MacGrove Painting or its licensors and protected by copyright and other laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Privacy

Your use of the Website and submission of information (e.g., via contact forms) is also governed by our Privacy Policy. By using the site, you consent to our data practices. Submitting a contact form constitutes consent to receive communications (calls, texts, emails) from us; message and data rates may apply.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved exclusively in the state or federal courts located in Ramsey County, Minnesota. You agree to submit to the personal jurisdiction of such courts.
